The Role Of Documentation In A Successful R&DTI Claim

Written by Shoaib Naveed | 26 November 2024

As a nation, Australia cares heavily about innovation. “Australia must become a ‘smart’ nation, drawing on knowledge and ideas to build competitive and sustainable businesses that create high skill, high productivity jobs and that capture value through integration into the global economic system,” the government notes in its Australia’s Innovation Future report.

However, for many years now Australia has also stubbornly hovered around 23rd on the Global Innovation Index, which is very low for an economy of its size. Addressing this requires positive interactions between the innovative private sector and the Government, and one step that Australia is taking is to lift investment into R&D from 2.1% of GDP to 3% of GDP.

It also aims to support innovation by reducing the risk for companies, and one example of this is the R&D Tax Incentive (R&DTI) program. Through this, this government aims to de-risk innovation to a degree by offering tax offsets for eligible R&D activities. However, the threshold to qualify for the R&DTI is high and maintaining comprehensive and accurate documentation throughout the R&D process is critical for organisations that want to explore the opportunity.

Why Documentation Matters

To put it bluntly: The ATO and AusIndustry, the key bodies overseeing the initiative, have stringent requirements to prove you’re eligible for the tax offset. Without proper documentation, businesses risk their claims being denied or subject to significant clawbacks following audits.

The R&D claim, prepared thoroughly, can potentially pay for several new software developers over the next few years. Or an extra team of engineers. You may choose to recruit and pay for highly skilled (and expensive) technical personnel using the benefits from claiming the R&DTI. This can be a massive boost to your company.

Making sure that your R&D documentation is kept organised is a small price to pay for this huge benefit.

Good documentation can be broken down into three requirements:

  • Firstly, it should demonstrate that the activities are genuinely experimental and aimed at creating new knowledge.
  • Secondly, it needs to show that the R&D activities were systematic and that a specific technical goal (a hypothesis) was tested and evaluated.
  • Finally, it should detail and prove how the associated costs were directly linked to the R&D activities.

From our extensive experience across many industries and clients, we know of many possible approaches and solutions to maintaining documentation to support the R&D claim. We can share our knowledge to help you develop a tailored document-keeping method.

What types of documents do I need to keep?

Every R&D project is unique. Therefore, every R&D project will have unique documentation requirements.

The key is to figure out what you have. Then, we can figure out what we can use, and what we need to work on.

With our extensive experience, we can give you a lot of help with that.

At a high level, the government bodies want to see documents to support all aspects of the R&D claim, but with emphasis on the following:

  1. The eligibility of the R&D activities being claimed
  2. The eligibility of the R&D costs being claimed

Supporting documentation needs to be contemporaneous. This means that the documents:

  • Were created by you as you conducted the activities;
  • Were not retrospectively created as an afterthought; and
  • Were not created solely for the purpose of supporting the R&D activities for the R&DTI claim

As documentation requirements are unique for every project and every company, we do not believe that providing generic advice here for you is the most effective use of your time and attention. Common Documentation Pitfalls

Another reason that many businesses look to outside expertise in this area is because they know they’re liable to make mistakes in the documentation. Having the right partner on board, such as Ascentium Australia, is an incredibly valuable resource for sense checking and making sure that you don’t fall into any of these common traps:

  • Inconsistent Record-Keeping: Failing to maintain records right throughout the R&D process can lead to gaps in evidence, making it difficult to justify claims.
  • Lack of Detailed Experimentation Records: Vague or incomplete experimental logs may not satisfy the requirement for “core R&D activities.”
  • Mismatched Financial Records: Costs that cannot be clearly linked to specific R&D activities may not be considered eligible for the tax incentive.

Essentially documentation means everything to being able to access the benefits of the R&DTI program – and any other government grants that you may highlight as an opportunity. It’s easy to understand why documentation is a common pitfall to these efforts – it is a time-consuming process to collect, organise and present.

More than a few businesses opt to forego tax concessions and grants simply because they would rather invest their time into other areas of the business. But that’s leaving money on the table that can be easily accessed with the support of Ascentium Australia. If you think you could be eligible then reach out to us to discuss!
